House on my mothers name, transfer to my name, with me 3 elder sisters
10-Nov-2023 (In Property Law)
I along with me 3 elder sisters married and signed on blank 100rs stamp paper, 1month back my mother expired, our house on my mothers name so now any use of 100rs stamp paper, what's procedure to register this property on my name or my father's name?
Sorry to hear about your loss.
If your mother has died in-testate, i.e. without a Will, then the property would be divided equally between Class - I heirs if you are all Hindu by religion.
Class - I heirs would include you, your siblings, and your father. You should then approach the concerned revenue authority to have the property mutated in your favor. There is no need for "registration" as such and no there is no use of the stamp papers you have bought in this process.
You may also file a petition for the grant of a Succession Certificate.
A succession certificate, under the Indian Succession Act, is a document that gives authority to the person who obtains it, to represent the deceased for the purpose of collecting debts and securities due to him or payable in his name. It establishes the authenticity of the heirs and give them the authority to inherit debts, securities and other assets that the deceased may have left behind.
