Handing over of the properties based partition case judgement

16-Apr-2023 (In Property Law)

Subsequent to the preliminary degree passed by court for the partition case, a commissioner was nominated by court to do the partition at site and to submit the report. Also now court directed commissioner to submit the report before mid of June month.I expect some restriction will come from our opponent party while dividing the property at site. If it so what should be precaution activity to be taken and if they object how the commissioner will respond. In case opponent cooperate, wat are the various steps involved before we take over the property in all respect and the tentative time period

In case of partition suit, when the commissioner submits the report in the court, the parties can object the report submitted by the commissioner. The court looks into the objections made and pass a partition decree accordingly. In case no objection is made then the court will pass the partition decree according to the report by the commissioner. You can execute the decree by filing an application of execution of the decree in the same court.
