Grandmother sold 16 beega and donated 2 beega. 13 beega cheating

My fathers maternal aunt (95 year old) sold 16 beega land to my mother and donated 2.5 beega land to a poojari to plough and take care of her ancestors temple using earning from land. Remaining 13 beega was registered by accountant on his own name ( by cheating and bribing) .. Can my grandmother challage that and even the donated land - Poojari not doing any Pooja at temple and is doing nothing even after getting the land. The land was registered in April / May 2017 .. Although in 13 beega registry the buyer claim he made the payment in full but there was no transaction done at all. Since muneem was taking care of her accounts he use to ocassionaly deposit cash in her account .. I am afraid he may show those transaction as payment for the land.. Can my grandmother challenge the registry of 13 beega and also file case to return donated land on the ground that receiver if the land is not standing on commitment as mentioned in donation deed.

Yes, your father's maternal aunt can sue the muneem for unauthorized transfer of 13 beegha land in his/her own name.

If donation was conditional and was for a specific purpose, donor can sue the donee for non-fulfilment of the purpose of the donation. If the poojari is not fulfilling the purpose of the donation, he may forfeit the right to retain the 2.5 beegha land.
