grandfather died intestate now uncle building house without asking us

My grandfather died without will his youngest son continue to live there after death but now he has started building new house at same place without asking other brother 4 son and 3 daughter of my grandfather youngest son (my uncle) claims that he has published a notice in newspaper that he is going to build house claiming his share in that land if it is ok the step he is following how other son and daughter can claim can we file 420 case on him

No 420 is made out since he is one of the co-sharer as per your query. Other co-sharers have a right to file civil suit for injunction restraining your uncle (youngest son of your Grandfather) from construction, for saving their share of claim or also have a right to claim partition of the joint property at the earliest.

Sir he can not do so unless and untill he takes NOC from other legal heirs. You can move estate office with application to stop him from raising construction and you can also file suit for partition before concerned court.
