Govt did not took possession of land after acquiring land

An area of 5.00 Acres has been acquired by Govt of India under urgency clause and passed an award of Rs.21000 in year 1960.Out of Rs.21000 they had paid an amount of Rs.3100 to us.But till date(i.e 2016 ) they have not paid remaining amount of award which was passed in 1960 nor they have not taken possession of the land.From 1960 to till date we pattedars are on the possession of the said land and paying revenue tax and other to state government Can you please help me out in giving me an opinion on the same that will 1960 award is valid can we acquire the land now as the govt. of india had fi

Sir,
1. In the instance, if the land owner of the property not compensated by the government or not occupied/ possession of acquired land within two years, then the land acquisition proceedings are deemed to be lapsed.
2. Since in your case the government neither compensated nor they have not taken possession of the land, from 1960 to till date.
3. Therefore the land acquisition proceedings are not valid one.

Hi
the 1960 award is still valid and you will be entitled for compensation as per the new land acquisition policy as per current market rates.
since the government has not taken possession of the land, by default the government needs to either acquire the land at current market rates or return the land back to you.
