Got property from sister and brother how to get property in my name

27-Aug-2023 (In Property Law)
I got 6 dhansnischaya adharam from my sisters and brothers after the death of my father intestate. How can I get this property mutated in my name. Since its an ancestral property all the legal heirs are eligible to get equal shares but major portion given to me from my brother and sisters because of their affection and love towards me eventhough there were two brothers who are also the beneficiaries. My two brothers didn't get any shares from other sisters and brothers other than what they are having . Please suggest your valuable guidance in this matter

In case of an intestate succession, all the legal heirs will be eligible for their entitled share. Ideally a partition among the legal heirs to be done for the benefit of mutation and all. It is okay to settle the share on one person in your favour. You can apply for mutation for your entire properties (your share and the share of your siblings you got through settlement deeds). For that you have to obtain the death certificate of father and legal heriship certificate. If it is still undivided, make sure to demarcate the property or the mutation will be difficult as the specific survey numbers and boundaries are required

After the death of your father, the property right transferred to his legal heirs (Wife and children s ) . so all legal heirs a have equal right over the property. If they create a relinquishment deed in favour of you become the absolute owner of the property,

The facts, as stated, are confusing. There appears to be no reason why there are six settlement deeds and also whether they are registered. If the property is intestate, it needs to be apportioned equally among all the legal heirs. However, each of them have the discretion to relinquish their or take lesser share benefitting some among the co*heirs or all of them.

From your question it is not clear that whether you property has been registered on our name...If it is already registered as the settlement deed with the SRO you can easily mutated the property. After the registration they will give you application for the mutation.
