09-Nov-2023 (In Property Law)
i gave power of attorney to my mother (for the property which she gifted me). now my mother is no more. whom does the land belong now
A power of attorney survives till the date of revocation/death of principal/death of agent. Since your attorney (ie., your mother) expired, the GPA authorised by you (principal) also expires. This is subject to a condition that prior to the death of the agent, if she acted in any manner to create a charge on property (mortgage, etc.,) or sale agreement it will have a binding on the principal. If no action has been taken by her as an agent, then the property ownership belongs to you.
