Gave house to family in need to stay can they claim ownership

We are Muslim family, residing at Mumbai & have an ancestor property in U.P.( 60kms away from Lucknow City). We have given a portion of our house to a needy family around 30 years back to stay. We have not collected any rent, neither they have paid any of the bills or maintenance till date. Since last 10 odd years we have been continuously behind them to vacate the property but they are not ready to move out. How can I get my property vacated ? Do I have to pay them anything for evacuation ? If I have to pay then what percentage can they claim ? Can they claim ownership of the property?

An eviction suit might not be maintainable as the person you are referring to is not your tenant. You could however file a suit for declaration of your title over the property and possession. There are no other requirements as such to file such a suit however you should ensure that you have enough evidence to prove your case.
