Gave cheque to book land for me but booked it on his name what to do

Ten years back, I gave cheque to a colleague to book land for my brother. However, he cheated me and registered land in his name and also took receipt in his name. The sale deed of the land is still not done. I have bank proof showing the cheque used for registration was in my name. Is there a rule in Banking Act which can prove that use of third party check by that person was illegal?

Check payments are governed by the Negotiable Instruments Act. You can file a case under criminal law for breach of trust and fraud. The main diaspora here is the limitation period as the timeline has already been 10 years past cause of action.

You can directly file a report against them in police station for cheating and further file a civil suit for recovery of the amount paid by you. You can also stop payment of cheque by issuing notice to bank.
