Friend having adverse possession of property how to prove it in court?

Me and my friend has bought 408 square yards in 1996 I have taken 208 and my frnd has taken 200 yards immediately after purchase I got transfer to other state so while going to other state I told him to look my area too now after 7years when I return he already constructed his home without leaving any entry to my land now it is land locked I have in 2005 made complaint in court.court ordered injunction order then by seeing the order he agreed to buy the land we have made the agreement for 3200000 he also paid 5lakhs advance the mistake we did Is he had the original agreement we had only photostat copy of the agreement now he is denying to pay the remaining amount and also saying that he never made any agreement and saying that he is having rights on my land on adverse possession now I have photostat copy in that it is having clear signature of his and also his thumb impression ...Can I send this photostat copy for forensic and can I use this as a proof against my case.. please reply

The question of claim of property through adverse possession does not arise since you had agitated for your rights in the year 2005. The claim for adverse possession arises if there is continuous and hostile possession for twenty years. You can file suit for recovery of possession of your property.
