Fraud in partition of agricultural land between siblings

My mother had a share in her father’s ancestral agricultural land. She had 5 siblings, 2 brothers and 3 sisters. My grandfather died in 2012 after which the whole agricultural land was partitioned between two brothers with the consent of 2 sisters who were actually present at that time and one fake person signed the same as my mother. Now can we get our agricultural land back as my mother was neither present nor did she voluntarily sign for her consent to give her share to the brothers?

Your mother is entitled to 1/7th share of her father’s property. The deed of partition that was made post your grandfather’s demise has to be signed by all the legal heirs. If your mother had not signed the partition deed she can move to the court for setting aside partition deed and claim her share in the property. Alternatively she can file a criminal case of forgery and criminal impersonation. It has to be proved that your mother’s signature was forged on the partition deed. She can eventually get back her share in her father’s property.
