Flat registered in my name how can I transfer it to my mothers name

05-Jul-2023 (In Property Law)
A own a DDA flat in Delhi which is registered under my and my spouse's name. I have taken a loan for this property and solely pay the EMI, however my spouse is also a co-applicant in the loan. I foresee a mutual divorce and prior to that, would like to transfer the ownership of my house to my mother. What is best way of transferring the ownership irrespective whether the divorce happens or not? As of now my spouse has agreed to ownership transfer. I am a Hindu by religion.

for transferring the owner ship of flat in your mother name either you have to sell it to your mother of you can gift it to your mother but in both cases you have to pay to complete loan amount and also have to pay a stamp duty. there are certain other remedy you have available if your wife is ready but for that you have to consult.
