04-Mar-2023 (In Property Law)
Respected Sir/Madam, My Father has a property in tumkur, received as gift. We are 5 daughter and 1 son to my father's 1st wife(late). He later got married(illegal) to another women without 1st wife's consent and later he had 2 daughters for 2nd wife. He transferred the property which he had received as gift to his 2nd wife without any consent from 1st wife's children. Now he was put out of house by his 2nd wife who has expired recently and the property is now in the names of 2nd wife's daughters. Please suggest if there is any way to get the property for 1st wife's children as well legally

Hi,
If father has acquired it with his own earning, he can dispose it as he wants. Daughter/Son have no share in her father self acquired property . Daughter/Son signature is not needed to sell it. Daughter/Son can signing as a witness not as a a confirming party as a legal heir. The sale can proceed without there signatures. She's signature is not required for the sale to take place.
