Father's brother start construction on ancestral property what to do
23-Mar-2023 (In Property Law)
My grandfather has given a piece of land to my father's younger brother and is about to start a construction on the land without my father's knowledge and my knowledge , being a grandson can I intervene in any way, please help .
If the said property of your grandfather was self acquired and he transferred it into the name of your uncle then, you can not do anything however, if the said property is ancestral in nature then, you can file a partition suit and injunction suit in the civil court.
Yes for sure, you may immediately file a civil suit for partition injunction and declaration. You should also pray for an interim injunction and stop the said construction so appoint a lawyer first issue a legal notice and upon failure initiate a civil proceeding against the said brother.
