Father transferred property to uncle when he was drunk can we get back

I want to know that is there anyway to getback our paternal property, as my uncle cheated with my father by taking signature when he is drunk. so i just want to know that is there any way to get back our property.

Yes you can challenge such transfer. You can challenge the transfer of property by your father to your uncle on the basis that your father was not his senses and was incompetent to make such transfer.

You need to substantiate the allegation you are making and sue against the person also in a competent court of law. kindly arrange the details of documents and then you may approach to any lawyer and brief the matter. advising on the civil matters without knowing much of it is sometime fatal.

All the contracts are illegal and unenforceable which were executed while in the state of involuntary intoxication.

so if you can prove that your father did not drunk on his own and he was made to drink without his knowledge by your uncle or anybody else, then your father can challenge the said contract in court and get it declared void and illegal. then it will not have any force of law and you will get possession of the property.
