Father sister claim ancestral property after many years can they do it
19-Sep-2023 (In Property Law)
i m from Muslim Sunni family, my grand father died in 1984 without will, his property transferred to my father. then in 1995 my father transferred that property to his son( to us ), we have possession on it since then. but in 2005 my fathers sisters claim n sue to father for ancestral property. QUESTION - CAN MY FATHERS SISTERS CLAIM SUCH RIGHT AFTER SO MANY YEARS AND AFTER TRANSFERRED TO US ?
The 2005 amendment does not help the Muslim personal law, which allows polygamy and extra-judicial divorce. When it comes to property rights, the Muslim law gives the daughter no more than one half of the share of her male counterpart. All the same, since the Muslim daughter has such an entitlement even in the self-acquired property of her father, she is better off than her Hindu counterpart.
