Father selling ancestral property without our consent can he do that?

Great grandfather bought property. By family settlement the property was divided between grandfather and his brother. Thereafter the property came to my father and his brother after demise of grandfather. Now my father is trying to sell the property without our consent. Can he do that? He is selling the portion which he feels will be more beneficial selling without any agreement with his brother. Can he do that?

As per Hindu Law, particularly Mitkashra School you have coparcenery right in the property and your father can only sell the property for joint family purpose if he is karta otherwise no and you may get injunction on this.

You farher cant sell the property without your concent. If he does so then the agrrement to sell is void. Further, you asked about the portion he is selling is more beneficial, thats depend upon many acts. Advice you to get in touch with me for further details.
