Father built house in grandmother's name how can we claim ownership

11-May-2023 (In Property Law)
we have a land and 2 floor house which was made by my father in 2002. since then my uncle use to live there and the land was mainly taken on the name of my grandmother long back since the house was made. My uncle was always dominating about taking deccsions and my father being an elder brother never wanted to hurt him. the house was made on 1/3 of the total land with honesty by my father. my father has died few months back and we have no earning member but even then my uncle do not want my grandfather to register that property on my mothers name and my uncle beats my grandfather as well.

For claiming ownership you hv to file civil suit for declaration and partition. The same can be filed before the jurisdiction of the court where the property falls. You can send them legal notice and also to prove your ownership tlyou hv to plead before the court

If property is belongs to your grand mother, you can claim the share in the property by the way of partition. For that purpose you have to file a case for partition before the civil court and if partition takes place your uncle will automatically get a share irrespective of his expenses over the property. Your father should not register the property in his mother's name. But we can't cure his gross mistake. You can only take a share in the said property. Nothing else. If your uncle beats your grandfather he should lodge a complaint in police station. Your uncle is behind the bars. Revert me

file police complaint as soon as possible and get the FIR registered and make video of your uncle when he beats any of you family member.

Also file the suit for declaration and take police help also.
also you can file suit for partition against your grandfather but then your uncle shall also receive some share.

But in case your grandfather makes the statement in court that all the properties were bought by your father , then your uncle cannot do anything.

If it is so as you mentioned in your query then why not you go for partition . Once you file partition suit your uncle will Certainlly bow down to you and you will get your right over he property.
Kind regards
