Father brought half piece of land can owner force to buy the remaining

19-Sep-2023 (In Property Law)
My father purchased a piece of land from a layer around 15 years ago, now he has started construction on that land (actually a home to live) that is in village because we do not have proper house. The problem is that my father didn't bought the whole piece of that land because of money at that time, now the person asking him to either purchase the whole piece of land (left part + some govt. land near to road which he stating that its his piece of land but during measuring its cleared that belongs to state govt.) or I will disturb you. Now he lodged two cases through his peoples not directly and he is telling that if we do not purchase the whole piece of land that he is demanding he will lodge some more cases. We have problem that we have less money that is either we can complete our construction or we con fulfill his demand and if we go for construction we have to deal with those cases and also we have to prepare for the cases that he will lodge. Thank you

The person who is a complaint harassing you there can be a civil remedy and criminal remedy which can be invoked against him by filing a criminal complaint and can also move to the civil court for the same and get a instant restrain order against him so that he does not harrases you in future by getting declared as a absolute owner of that property through a civil court along with you can also file a suit for damages against him.

you will have to file a suit for permanent injunction in the local court. he cannot force your father to buy any land. you can also file a complaint with the police saying he is threatening your father and his family.

As the position of the law stands, your father cannot be forced to purchase the land which he doesn't want to purchase. He has complete freedom over the usage of his income.

In the current case, you need to talk to the persons who have filed cases against your father and dissuade them from filing false cases.

I would love to help you out. Do reply if you would like to discuss the matter further.
