Farm land and house sold by father to his 2 sons out of 5 sons

BG- hindu Property in name of grandfather (X) X1 & X2 & Y He has 3 sons property Y given to 1 son & X divided in 2 sons He made a statement 4 partition before 1 month of dyeing in year 1961. Now propertyX2 is sold by father to his 2 sons out of total 5 sons for repayment of loans on him. He was solely dependant on the agri income but went in loss and incurred loans. Now 1 son has filed a suit for partition saying it is ancestral property and sale deed is null and not binding on him. Sale in 2003 & he filed in prant off 2008 which is lost and filed suit in 2010 Pls advise our stand

Ancestral property can be equally divided among 5 brother . If no proper partition is not done then it is not binding on other brother. Therefor they can file suit for partition and suit for declaration.
