Family Property Dispute want to apply for partition in jamshedpur

I want to apply the petition for separation my family property in Jamshedpur, Jharkhand. We are 2 brothers but my elder brother is capturing the whole properties slowly, smartly and forcefully. I stay in Bangalore as I am in job. My parents are alone there and due to their age they are also helpless. Me and my complete family have been suffering from domestic violence for last 5 years. My father also did a case against him before 3 years around but withdrawn it due to his continuous life threatening. So, I want to file the case or apply the petition for separation

File a Partition suit for seperation. What was the case your father did.. mention the details alongwith the withdrawal order. Take immediately and stern actions... First collect all documents regarding ownership of property..

I perused your query meticulously and found that your elder brother doesn't want to give share to you in family property. In such case if your father is alive and he is ready to support you then first made a WILL/ GIFT DEED/ GPA from your father so that in future can't alienate you from aforesaid property. Thenceforth, file a Partition suit in which raise your share as a legal heir also made a Performa party to your father so that he can support you in that suit and also file one criminal case for life threatening against elder brother for the sake and object of security of yourself and your entire family members from your elder brother.
