Failing to obtain stay order from court before illegal construction

We belong to village- Bhangwa, District- Pratapgarh, uttar Pradesh. We have a land in our village of around 12 i.e.approx 1680 yards.This property was not used for few years by their legal owners. We are hindu. But Suddenly one of our neighborhood who is poor and belongs to sc has quickly constructed one room in a single day with the power of some rowdy. Our lawyer has unfortunately failed to obtain stay order before construction. i want to know what should be done next to acquire such property. What should be keep in mind in Court.
as the lower court has not given you the relief i.e stay order you were looking for. what you can do is file an appeal in the superior court against the order passed by the subordinate court. this is the next step what you should take
