In the present case, the advertisement in the local Newspapers is not required as the Property is transferred via a proper executed and registered document i.e. Gift Deed.

Further, there is no requirement for your Father to give a NOC as requested by the Society for the above mentioned reasons.

In addition, the demand of Rs. 25,000 as Transfer fees is illegal and the Society is only trying to milk out the money from in the garb of transfer. It is settled law that no transfer fee is chargeable in the event the property is transferred in the family which I understand is the case here.

I suggest that you write a letter requesting the Society to issue you a proper request on the above mentioned points.

You need to pay transfer fees to society. Since it is transfer in firm of gift to blood relatives you need not give advertisement. You can give indemnity bond to the society. Pleaee let me know in which state you are located as cooperative laws differ.

Transfer fee is mentioned in the society bye law. Please read carefully the bye law of the society. It is mandatory to give public notice in local news paper in vernacular language for transfer of society share to any family memeber in order to avoid future consequences of law. Public notice had no relation to any RELIGION.
