sir, we are hindu , mere papa log 2 bhai aur 2 behne hai 1.(SISTER) 2.SISTER 3.ELDER BROTHER 4.YOUNGER BROTHER (yeh question chote bhai ka ladka kr rha hai) hamari ek shop hai jo ki mere dada ji mere papa(anil malhota) ko de gye hai lekin wo shop rent ki hai aur mere bade papa (ashok malhotra) usme apna hissa chahte hai, jaise ki wo shop rent ki hai toh kya hme aaj ki date ki jo bhi shop ki half value hai unhe dene padegi aur mere bade papa ki alag se personal medical store bhi hai aur wo shop unke personal ki hai rent ki nahi hai phir bhi wo chahte hai unhe (ashok malhotra) ko hissa mile... yeh shop mere dada ji ne 100 years ke patte par li thi jiske abhi bhi 30-35 years bache hai aur sabhi papers bhi mere papa (anil malhotra) ke pass hai...toh sir iska solution kya ho sakta hai.... In response to your query, I would like to opine that the shop is having a lease of 90 years in name of your grandfather and now after his death, the lease would be trasferred to successor as per the lease deed. If ur grandfather has made a will in favor of your father, then he will be having rights. But if there is no such, then ur uncle has equal rights with ur aunts alongwith ur father. Further, the other shop is property of ur uncle, hence its no concerned with the said issue. Your father can retain the documents if the shop is in his name as per above and the same need to be updated in the records of the Lessor. Thanks

If there is no family settlement then shop will be devided in to equal share. If there is family setlement then shop will be decided according to settlement. In the parental property each brother has equal share.
