Division of grandfather's agricultural land among legal heirs

03-Apr-2023 (In Property Law)
My grandfather has 8 children. In which 6 are sons. He divided his agricultural land in the name of his children in the year 1970 through a partision deed which is registered. But in the year 1980 my father and his younger brother exchanged the land given in partision deed between them through the formalities in Taluq office(through 21form) by mutual understanding. From past 36 years we are using the land which we exchanged. We have plantation done. We are paying land tax to the lands we exchanged from past 36years. And even we have taken loans from bank. But these lands are transfered to me nd my brothers from my father in the year 1993 through panchayat palparikat(not registered)which includes the sign of my fathers brother too from whom he exchanged .My fathers brother and his wife passed away 13 years back. But now their four daughters are claiming for the land given to their father in 1970. How will this cause problem to us?Plz suggest.

Your case is very perfect. You can transfer your property based on Panchayat partition deed. The children of your father's brother can't have any right in property which has been exchanged. You can also claim ur property

See as you informed that your grand father had partitioned his property and as per this partition your father obtained the certain portion of the land. As per law after the such partition your father will become the absolute owner to his portion.

Further you have informed that your father and his elder brother exchanged their portion of the property under due process of law. When it was legally exchanged, your father automatically looses his right over his portion which is obtained under the aforesaid partition and automatically he will become the absolute owner of the exchanged property.

Your father transfered the same to you and your brother in his personal capacity as a absolute owner over the same.

Any way there is long delay in claiming the properties by the daughters of your uncle. Once the property has exchanged legally, they cant claim or challenge the partitioned property as per partitioned Deed.
