Division of a joint property

Division or partition of Family house,which is in the name of 5 brothers. 4 brothers are ready for partition. the one living there is not willing to divide the property. he has also been offered first right to choose whichever portion he wants. we want to get it done at the earliest. Also, wanted to know the time and constraints of the legal system in such cases.
In case where all the brothers have equal right over the property, you can file a partition suit in the civil court for the property. Where court will order to divide the property equally among the 5 brothers.
