Delayed Possession & Incorrect Possession Date. notice from builder

I bought an apartment in Pune in 2007 with promised possession in 2009. Keys of my flat were offered in Feb 2010 when the overall society was still under construction with no completion certificate and only permission to bring furniture inside. I refused. Come Sep 2010 full payment was taken from me under the false promise of completion certificate. Final possession with completion letter (dated July 2011) given to me in Dec 2011. In Apartment Assoc. records possession to me was given in Feb 2010. Builder lawyer has sent a notice of outstanding maint.and penalty dues. What should I do? Thanks.

first of all you should reply the said notice stating all you greviances and complaints and it would be better if you reply through a lawyer so that proper legal reply will go. prima facie it seems that you have just and proper reasons and act of builder is not proper and legal . there are civil criminal remedies availbale for you by which you can prosecute the said builder and concerned persons before the court of law.
