Daughter's right in father's property

hi all i lost my father 3 yrs back.we are4 sibling 3 daughters im the last and have one younger brother.after my dad death it all got transfered to mom and bro name.but he hasent disclosed what are the asset and and bank bal.im asking him share in the bussiness,but he says girls are not allowed in bussiness share.he will give property after all litigation is over.kindly advice as im a single parent.till now i dont know my dads property. n thanking you r

As a daughter as well as a legal heir you are entitled to a share in your father's property if your father has died intestate(without any testamentary document like..will, gift deed etc). If your brother and other members of your family deny your share then you can file a civil case for partition and declaring your share in your father's property.

Refer to the latest judgment made by the Honorable Supreme Court in AIR 2015 SC 6160 where it is clear that which daughter has rights in the property and how does not have, the recent judgment prevailing help you to get the property by approaching court of law with a prtation suit

Sir,

As your father has passed away your mother is the direct own of it. You miter can make a will and give the said property to you or she can also make a gift deed and register the same.

As property is self acquired father can alienate it as per his wish and will. Nobody can demand fathers self acquired property against his wish. If daughter give threat for filing court case then give her notice through lawyer for threatening to father.
