Daughters right in fathers ancestral as well as self occupied property

16-Nov-2023 (In Property Law)

I am married women since 1989 staying with my husband and children. My father died in 2003 leaving behind 5 daughters(including me) and 3 sons besides our mother. My father had some ancestral property (not partitioned between my father and his brother) as well as some self occupied property. After the Honble Supreme Court decision of Oct'2015, what will be my right on my fathers ancestral property as well as self occupied property. If I am entitled for a share in the self occupied property then can I dispose/ sale the same.

Dear Mam,

On the basis of the date of death of your father, it seems that your claim in the properties may not arise. However, if the properties remain joint and are not even notionally divided, you can claim your share.
