Cooperative housing society not letting parents stay in the house

I am a female and had bought a property in a housing cooperative society in kolkata in 2008. At that time i was unmarried. In 2009 i got married and left the city amd the flat was put up on rent. Now i have got the flat vacated this year and want my old parents to stay in my house with full power of attorney however the society has said that they will treat them as tenants and not owners although i have given my dad a power of attorney for looking after the affairs of the house. They are citing reasons that the parents cannot stay in a daughters house as dependents. What should i do?

Check whether there is any cLause in your deed or may be the rules of the cooperative which restricts any transfer. In any event tell them you are staying at the property but since you have to stay with your in laws, for upkeep of the property and its maintenance, your father is looking after it. Legally they can't stop you by why invite legal battles

1. The society is wrong in holding that your parents will be treated as tenants and can't stay in your property.
2. Send a legal notice to the chairman asking him to allow your parents to stay.
3. If they still refuse lodge complaint with registrar of cooperative society.
4. Thereafter you can file writ petition in high court.
