Construction of house on partioned land

23-Feb-2023 (In Property Law)
Hi, I would like to get advice from lawyers with regard to constructing a house on a partitioned land. this land is in the name of my mother and am her son decided to construct a house since there is long time conflict between my mom and other siblings (2 brothers) on land dispute and others. we feel that they will give any false complaint or file case to put on hold for construction. since one of the sibling is already a lawyer in chennai. so is there any possible to legally stop them in the first instance like if they give such unwanted troubles and false complaints(like boundary issue ans set back violations etc. )our documents are everything is very clear. but still directly or indirectly(thro neighbours) they will give trouble to us. can you please advice how to avoid certain things without interrupting them into our construction?

I have gone through your question.
Your mother and you can try to obtain an injunction from jurisdictional Court against those other siblings.
Later with regard to further progress of the case a lot depends on how the property came to be in your mother`s name, and I can only tell after studying the origin.

Don't worry most of the peaple give a trouble like this, you have very clear documents and u hv a very clear partition nothing issue on that but when you started your construction they start to give trouble that's why u should file injunction order against them is this case have a benefit to you and they lost the right of unnecerily interference thank you

You have to start the construction strictly as per plans to avoid troubles from your neighbours. I f they start troubling you can lodge police complaint and ask their protection. You can as well file a civil suit for permanent injunction against your relatives. Feel free to contact me for further course of action. ,
