Compensation from builder for late possession 1 year delay

The builder has delayed property possession by almost 1 yr now due to some accident on site. Not ready to talk on compensation part. All flat owners have decided to form CHS and fight against him. My question 1) is it possible to form Corporative Housing Society without occupancy certificate? By owners on their own as building is still under construction 2)How much time does it take and roughly the charges incurred? 3) is it necessary to form CHS for fighting for compensation?
in this case you can send him a legal notice stating your demands and concerns. if he does not comply with the terms of the notice then you can file a suit for recovery of your money in the court of civil jurisdiction. however you can also file a consumer complaint.
