Clarification on partition of property between legal heirs

29-Mar-2023 (In Property Law)
Father died 26 years back, and Mother is 80 years now. There are seven heirs to my father's property consisting of huge orchard and a house where my mother lives now. Besides some of the heirs of the seven are also getting aged and are above 60 years. 1) Can my mother make a will to gift her share to any prefered heir ? 2) What happens if the will is faked while the mother is in the state of Dementia or sick without conciousness ? 3 ) What is the procedure to divide the house and property while she is in a sound state of mind? Can the subdivision of the property be implemented through court ?

The best way is to institute an inventory proceeding before a court to divide your father's property amongst the heirs. With will she may only be able to give 1/2 of her undivided share to one particular heir.
