Civil Suit Permanent and Mandatory Injunction dismissed with default from civil judge, then O9R9 application also dismissed with default from appeal (AdJ & delhi high court) on 2012 for non prosecution, WS was not file by defends can I file again a fresh suit now?
Depending upon the nature of the suit and the cause of action, and if the same continues, then you may file a fresh suit..

the fresh suit will be bar by the principal of res judicata you are advice to file application reviving the previous suit before the civil judge the condonation of delay will be the crucial factor. whether the delay will be condon or not.
