Cheating And Fraud In Allotment Of Plots in Bangalore how to proceed

I invested in purchase of two one acre plots in Maharashtra from a Bangalore based company in 2010/2012. The payments were made in installments with an initial down-payment. All installments were paid in time and the plots have not been handed over by the company. They have overshot by a period of two years. We are entitled to a refund along with the interest according to the agreement. For the past three months we have been communicating with the company executives who send us from one person to another week after week. And now they have stopped taking our calls or responding to our emails. I am very disturbed that our hard-earned money has been usurped by fraud. What are our options for taking action against the company. Would it be a case under the consumer court or regular courts?My husband is serving in the Army and would be retiring soon.MayI request for an early response . Thank you.
