Cancellation of registered lease agreement after court eviction

25-Mar-2023 (In Property Law)
A property was leased to HPCL for petrol pump in 1978 and agreement was registered. Lease period expired in 1988 but tenant refused to vacate and litigation ensued and final court order to vacate obtained in 2016. The property was vacated and all structures removed and vacating and handing over document was issued and signed by both parties. Is it necessary that this document should be registered or should the previous registered agreement be cancelled in the sub-registrar office?

yes the said document should be duly signed by both the parties, as the lease period expired in 1988 the lease agreements already stands cancelled. Thus, you will have to get this document duly registered in the registrar's office.

There appears to be no necessity in either registering the cessation of the lease agreement or the cancellation of the previous registered document. This all the more so because there is no element of reconveyance involved.
