Can wife claim from the share of husband which he his releasing?
15-Jan-2023 (In Property Law)
my mother has 6 children. when she dies last year the property share was divided equally between us i.e 1/6th. my brother is releasing his rights towards one of her sister. can the wife claim any right from the share of her husband?
Yno. Unless the share being so released by him takes away any right of hers to stay in her matrimonial house.
The wife cannot claim any share in the property of her husband. Once the husband gets a share in the property upon death of his mother, law deems his share of the property to be his self acquired property.
That depend upon many facts. Request you to please share all facts e.g Type of property, Children details of your brother etc. After knowing all the facts the proper advice can be given.
