Can we sign MOU for constructing combined villa
20-Oct-2023 (In Property Law)
we two adjacent plot[4.1cents each] owners do desire to construct a twin villa spreading in both plots as one unit encroaching each other's limits.we are ready to sign MOUwith suitable wordings and being blood relations we propose with no gain or loss belief among us.we are eagerly waiting for suitable guidelines in this leagal aspect. Our land is situated in Guruvayur municipality in thrissur district in kerala. EAGERLY WAITING FOR YOURS FAITHFULLY
As to my knowledge, this is a novel, but untested arrangement. This is all the more so, when yourself propose, in your own words, to encroach each other's limits. Theoretically, anyone can utilise or dispose of his discretion. However, your first hurdle would be how to get the building plan approved!
It would be better to ask your builder to construct the separate villas for each of them. And if you already started the construction definitely there must be an agreement among you and that must be registered with the sub register office.
