Can we make regular conveyance deed in absence of developer

Draft regular conveyance deed of developer with registered Co-op. Housing Society in Mumbai, mentions that developer will retain rights of future FSI to themselves, depriving Society. A deemed conveyance document may not have any such clause. If developer is not traceable now, between 'normal conveyance' and 'deemed conveyance' of land/property to CH Society in Mumbai, which option is advisable for the Society to pursue? The eligible FSI is likely to be increased by BMC. In regular conveyance, in absence of developer, can Society claim the extra FSI as per new DP rules 2014-2034 of Mumbai.
