Can we held liable for purchasing a Property from bank which was Mortg

13-Nov-2023 (In Property Law)

Bank sold us some property. Other person to whom the property belongs is now threatening to file a case against us. The property sold to us was mortgaged. Now what action can the original owner take against us? Are we going to be held liable?

No but will have to see whether bank has followed all legal steps while selling the said property to you in normal case bank always takes care of all legal aspects and then only proceed further so prima facie nothing seems wrong. Let the owner file or proceed legally you may defend it and just for precautions to should inform the said acts and facts to you local police and bank in writing immediatelyand keep all the correspondence alongwith it's acknowledgement..
