Can we challenge in kolkata HC on the basis of Judgement by Bombay HC

Flat Owners' Association as per practice in Kolkata charge owners maintenance on sq.ft basis whereas Bombay High Court in its landmark judgement states " EQUAL & UNDIVIDED FACILITIES & EQUAL MAINTENANCE CHARGES" IRRESPECTIVE OF SIZE OF FLAT. We are in trouble. Can we challenge Kolkata practice in a proper court citing Bombay High Court verdict?
