Can the sale of an ancestral property be stopped by the legal heir?
20-Aug-2023 (In Property Law)
After the death of my paternal grandfather, my ancestral property was divided between my mother (as father was deceased) and my uncle. Currently the property is in my mother's name. My brothers and my mother are trying to sell that inherited property without giving me my share. Do I have any legal claim to that and how can I stop the sale of this land? The property is located in Bihar and I am in Ranchi. Can I file any case in Civil court in Ranchi ? Please guide me as to what steps can I take.
Venerated Sir,
As per your query you want to know about the right in ancestral property. I would to onfor you that as a legal heir you have right in ancestral property by birth and no one shrink your right, so you have right to file civil case against her heirs for claim of ancestral property. Feel free to call me.

Technically you cannot file a case in Ranchi until there is any property of Ranchi involved too... you will have to file case at Bihar if it is the only property you are seeking partition of issue them a legal notice at present.. and see whether the matter is amicably resolved.
