Can subsidiary company registered abroad hold a property in India

09-Jun-2023 (In Property Law)
I am planning to launch a hotel startup in India, but my holding company would be registered in foreign country and continue my business as subsidiary company. So my question is 1. Would I be able to buy independent residential house in the name of my subsidiary company and turn it to tourist guest house? 2. Would my subsidiary company be able to buy any kind of agriculture land or any type of land for future building up guest house?

1) As a subsidiary company, you are bound by your charter documents, i.e. MOA and AOA. In case your charter documents permit you from purchasing property for official use, then you can go ahead.
2) The laws to purchase agricultural lands differ from state to state. Please specify the state in which you want to purchase the land.
