Can sister in law get share in father in laws property

26-Jun-2023 (In Property Law)
My sister's husband is died 1 week before (who is an Alcoholic addict) and they have one Autistic child and one normal child. Now her mother-in-law force her to get out of the home. So my sister is cornered and helpless. My sister's father-in-law bought a house 1 years before and her husband is the only one male person in his family and he has 3 sisters. Now his family refuses to give share to my sister. Please provide us your suggestion to get the right to my sister.

There is no provision in law that your sister can claim a share in her father in law's property on any basis.

Her father in law can refuse and deny her any share in his own property,

she cannot claim it as a right.

She has rights in her husband's assets alone and in that also her husband's mother who is one among his legal heirs, can claim a legitimate share proportionately.

So dont fight a losing legal battle, it is a mere waste of time, money and energy.

Instead rope in some elders of both the sides to reconcile between them especially on humanitarian grounds considering her plight with two children out of which one is autistic as well.

If the property was bought by his self earnings, that property will be considered as self acquired property. If the father in law is alive, daughter in law can not claim any share over the property.

In case the father in law dies without any will, the daughter in law is having every right to get share.
