Can my sister claim share in my mothers property

09-Jul-2023 (In Property Law)
Hello in my mother's property does my sister's also have the right to share. If I register the property in my name with my sister's agreement then in future they disobey and file a case then does this case wins. I had spent and give lot of money during my sister's growth and marriage yet I have doubt now that they may file for share, My mother and father are alive and iam the only son with two younger sisters My mother said to file for gift registration and sisters shall sign for no objection, does my brother in law's also need to sign on no objection during registration.

Hi
If your mother can execute a gift deed in your favour with your sister's providing No OBJECTION and also signing as witness, then the gift deed is valid.
there is no requirement of your brother in law's no objection or signature as witness

SIR,
in your case the best way is follow your mothers advice. she is ready to gift the property to you and your sisters are also ready to give no-objection you go for it, this is the best option for you. your brother in law's need not to give any no objection at the time of registration. if you register the property with your sisters consent there will be no problem for you if they file any case against you for partition in future.
now answer to your question
the property which your mother possess is self acquired property or ancestral in nature has to be determined. only then your stand will be decided. if it is self acquired she can give that property according to her wish and will. if it is ancestral your sisters are also have the right in the property.
