Can my sister ask for the share in my Fathers Self Acquired property?
02-Nov-2023 (In Property Law)
my father is no more. he had earned a property/ land around 10 acres in our hometown. my mother wants to give it in my name. but my married sisters are asking for there share or money against it. what can i do?
self-acquired property of a person who died intestate (without writing a WILL) is equally distributable among his heirs including married daughters. If they accept money and release their share, the same can be done through a registered deed.
If it is your father's self acquired property then your mother has limited interest only in the property left intestate by your deceased father. Your mother's interest in the property shall be restricted to only her share out of the said intestate property and she may settle or execute a gift deed or relinquish her share in the property in your favor or to anyone of her choice, nobody ca question that, however she is not entitled to entire property hence she has no rights or interest or title to transfer the entire property in our name. In fact you too have a legitimate right to a share in the said property besides your mother and your sister. Therefore you cannot deny your sister of her share in the property.
The solution to this shall be arrived by an amicable meeting and family settlement alone or she may approach court for seeking her legitimate share in the property then you may not have a choice than to allot her with her share and separate possession of the same.
Take time to think and make a wise decision at right time.
