Can my mother get a share in her father's property?

My maternal grand father died intestate 7-8 year ago.Now my two maternal uncle has sold some of the Land ( property) of my grandfather and got around 91 lacks out of it. They are total 4 siblings two brothers and two sisters including my mom. Now my uncles(mama) refusing to share Land money with my mom, is there any way my mom can ask it legally. how can she claim?

Dear Concerned,

As per law, daughters have an equal share in the father;s property as Class I legal heirs. Therefore, Mamas will have to definitely share the said sum with your mother. You please file a suit for the said purpose. Also seek partition of the remaining property.

Since her father died intestate, she has a right in the said property like that of her brothers that too in equal proportion. She can claim the same from her brothers by filing a suit in the court of competent jurisdiction. The court can pass an award in her favour and against her brothers

Dear Sir,

You are entitled to the share in property, you would have to file a suit for declaration and also injunction to get a share in property as well as stop them from selling more property to the matter is decided.
