27-Jan-2023 (In Property Law)
My Grandfather had 3 son and 4 daughters, all daughter got married before my grand father's death and now after 15 years they are now asking for the share in the parental property. Do they have legal right to the parental property, if yes, please elaborate the complete law and the procedure to follow. Moreover please help me with the procedure to divide the property and monetary assets equally among all the brothers as there is no will left behind by my grandfather.
Yes u have right in ur parental property. If you are Hindu. According to Hindu law u can file a civil suit to be get ur right. Please give your full information about your matter. Because it is necessary for ur query. Thanks
Your aunts can claim equal shares to that of your father and uncles, so there will be 7 equal shares of the property.
For this partition, if all the heirs are agree, can execute a registered family settlement deed, and partition the property according to the deed. But, if all the heirs are not agree, then you will have to file a regular civil case for deciding the shares of all the heirs.

If your grandfather died intestate and the property if your grandfather is his self acquired property then as per sec 8 of Hindu Succession Act the same shall be automatically devolve into the names of the preferential class 1 legal heirs. In preferential class 1 legal heirs the wife and the children of the deceased person falls, so accordingly in your case all the class one legal heirs of your grandfather does have the right till they are alive for their respective 1/7th share in the property of your grandfather. If not devolved then can go for the partition suit to file before the court of law
