Can legal heir claim right on property gifted by owner to mother

21-Mar-2023 (In Property Law)
Dear Sir, I need your assistance regarding a property that is gifted to my mother by my great grandmother. The said property is bought by my late great grand mother and she gifted the property to my mother( registered gift). My great grandmother has one son who has three sons and now one of my uncle's son is claiming right on the said property. After the property has been gifted, there were no claims but after 13 years a case has been filed by cousin. Please advice whether the property comes under the suit.

No the said property is self acquired by your great grandmother and that too was transferred to your mother by a way of gift deed, thus, it can not be divided among the other heirs because it is not ancestral property. Your Cousin might have filed the case on grounds that it is of ancestral nature but it is not so.

Respected questioner,
As per your question I would like to inform you that if great grand mother had property from her self acquired property then she had right to transfer her property to anyone. If uncle's son claim his right over gifted property of your mother then you have good option under law to dismiss the claim through court. Free to call me through lawrato. Because I need more information for better assistance.

dear client.....
NO they do not have any right to make any claim for the said property
but since they have filed a case claiming their right in the said property hence you need to strongly oppose the same and shall contest the case....
