Can i sell the ancestral property

Hi, Ancestral property was divided among 2 brothers. My father has got one side of the building divided horizontally (staircase side) & his brother has other side of the building (Garage side). it has 4 floors, now my father is no more, we want to sell our portion and my uncle is not agreeing. is there any solution for this, pls help.

Will have to see what are terms agreed upon by your father and your uncle at the time of dividing the property. If there is no restrictions in the partition deed then you can sell your portion and your uncle can't restrict you.

sir, Is there registered partition? if so, you are entitle sell the property. IF not registered, then, you can not sell without permission of your uncle. Firstly, know it, there is registered partition or not. pl consult.

You should first get a legal notice issued for partition against your uncle . You ate not required to hold the part of your property and live there for ever at the mercy if your uncle. But take care to get the legal notice properly issued. Without fault.
